These Terms and Conditions (‘Terms’) govern your use of the Harvest Hub website (harvesthubmarketplace.com) and the Harvest Hub garden planning application (harvest-hub.ai), operated by RD Urban Green DBA Harvest Hub (‘Company’, ‘we’, ‘us’, or ‘our’), located in San Jose, California.

By accessing or using our website or application, you agree to be bound by these Terms. If you do not agree, please do not use our services.

 

About Our Services

Harvest Hub provides a free digital garden planning and tracking application for home gardeners. The app helps users plan growing spaces, track plants, receive zone-aware care guidance, and log harvests over time. A paid subscription tier (Garden Plus) is available with additional features.

We do not currently operate a marketplace for the sale of produce or food products. Any future marketplace feature will be governed by separate terms at the time of its launch.

Eligibility

You must be at least 13 years of age to use our services. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at information@harvesthubmarketplace.com if you become aware of any unauthorized use of your account.

You may not create accounts using automated means or under false pretenses. We reserve the right to suspend or terminate accounts that violate these Terms.

Free Plan and Paid Subscription

The Harvest Hub free plan is available at no cost with no time limit. No credit card is required to use the free plan.

Garden Plus is a paid subscription tier offering additional features. Subscription fees are billed on the schedule displayed at the time of purchase. You may cancel your subscription at any time. If you cancel within 30 days of your first payment, you are entitled to a full refund — no questions asked.

We reserve the right to change subscription pricing with at least 30 days advance notice to existing subscribers.

Acceptable Use

You agree to use our services only for lawful purposes and in a manner consistent with these Terms. You agree not to:

• Use our services for any illegal purpose or in violation of any applicable laws

• Attempt to gain unauthorized access to any part of our services or systems

• Transmit any content that is harmful, abusive, defamatory, or infringes on the rights of others

• Use automated tools to access, scrape, or collect data from our services without prior written permission

• Interfere with or disrupt the integrity or performance of our services

Intellectual Property

All content on the Harvest Hub website and application — including but not limited to text, graphics, logos, app design, AI agent prompts, and planting guidance — is the property of RD Urban Green DBA Harvest Hub and is protected by applicable copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use our services for your personal, non-commercial use. You may not copy, reproduce, distribute, or create derivative works from our content without prior written permission.

User-Generated Content

You retain ownership of any content you submit to Harvest Hub, including garden data, journal entries, photos, and harvest logs. By submitting content, you grant Harvest Hub a limited license to store, display, and process that content solely for the purpose of providing our services to you.

We do not sell, share, or use your garden data for advertising purposes. See our Privacy Policy for full details.

Garden and Growing Guidance

The planting guidance, companion planting recommendations, and care advice provided by Harvest Hub — including AI-generated content — is for informational purposes only. Results will vary based on local conditions, soil quality, weather, and individual gardening practice.

Harvest Hub makes no warranty that following our guidance will produce any particular yield or result. Growing food involves inherent variability. We encourage gardeners to observe their specific conditions and adapt guidance accordingly.

Third-Party Links

Our website and application may contain links to third-party websites. We are not responsible for the content, privacy practices, or accuracy of any third-party site. Linking to a third-party site does not constitute an endorsement.

Disclaimer of Warranties

Our services are provided ‘as is’ and ‘as available’ without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our services will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability

To the fullest extent permitted by applicable law, RD Urban Green DBA Harvest Hub shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from your use of our services shall not exceed the amount you paid to us in the twelve months preceding the claim, or $100, whichever is greater.

Indemnification
